The examination of a suspect is a process in which an investigative agency, such as a prosecutor or judicial police officer, asks a suspect questions about the case and listens to his or her statements. The examination of a suspect is an important criminal procedure that helps discover the truth about a crime and contributes to the economy of litigation. However, the recent amendments to the Korean Criminal Procedure Act have significantly changed the system of Examination of suspects in Korea. This talk will examine the content, procedures, and features of the U.S. and South Korean`s examination of suspects. It will also briefly examine the criminal process in general, including police and prosecutor cooperation, and the trial system. In doing so, Prosecutor Kim hopes to explore how the cultural backgrounds of the United States and South Korea have influenced the criminal process, and to reflect on how best to ensure truth, discovery, and the protection human rights.
